WHEREAS, the Board of Directors is empowered by Article 10 of the Declaration and Article 7, Section 7.1(a) of the By-Laws with the authority to adopt and publish Community Codes and other rules and regulations of the Association including, without limitation, those relating to the use of the Community Property and any facilities situated thereon, and the personal conduct of the Members and their guests thereon, which apply to all Owners, tenants, occupants, guests and invitees of any Living Unit within the Association, and to establish penalties for the infraction thereof; and

WHEREAS, Article 10, Section 10.2 of the Declaration and Article 7, Section 7.1(e) of the ByLaws and provides the Covenants Committee, through the Board of Directors, the authority to levy fines against Owners of Living Units for violations of the Governing Documents of the Association; and

WHEREAS, Article 10, Section 10.2 of the Declaration provides that the Community Codes shall have the same force and effect and binding nature as the covenants, conditions, easements and restrictions contained within the Declaration and applicable to all property within the Association; and

NOW THEREFORE, BE IT RESOLVED that the Board of Directors of the GlenRiddle Community Association, Inc. hereby establishes the following Rules and Regulations for the Association which shall be binding upon all Owners of Living Units, tenants, occupants, successors, heirs, and who currently, or in the future, may possess any interest in the Association.

RULES

1. All leases must be in writing.

2. Every Owner of Living Unit who leases a Living Unit within the Association shall require the tenant to execute an Addendum to Lease for any Lease or the renewal/extension of a current Lease and provide a copy of the executed Addendum to Lease, together with an executed copy of the lease to the Association’s property manager within ten (10) days of the date of the execution of such Addendum.

3. Owner of Living Unit shall provide the Addendum to Lease to any real estate agent, Management Company, or other entity assisting in the rental of a Living Unit.

4. The Tenant agrees to promptly report to the Landlord or in an emergency the Association’s property manager any defect or need for repairs for which the Association is responsible.

Owners of Living Units Responsibilities

Owners of Living Units shall provide to his or her tenants at the time the Lease is signed with copies of the following:

The Rules and Regulations of GlenRiddle Community Association (Rules and Regulations)

Tenants have the right to request copies of the following:

  • The Declaration of the GlenRiddle Community Association (Declaration)
  • The By-Laws of GlenRiddle Community Association (By-Laws)

A tenant’s failure or refusal to obtain or receive copies of the aforementioned governing documents does not in any way exempt them from abiding by the covenants, conditions, easements, and restrictions contained therein.

Likewise, the tenant’s agreement to abide by the provisions of the Association’s governing documents does not in any way relieve the owner(s) from responsibility to do the same or for violations of the same committed by the tenant(s).

Tenant’s Responsibilities

Tenants, occupants, and guests of any Living Unit within the Association shall agree to be bound by the Governing Documents of the Master Association, including the Rules and Regulations.

Failure to comply with the Governing Documents shall be considered a default under the Lease.

Tenants shall control the conduct of his/her family members, guests, and invitees to assure compliance with the Governing Documents of the Master Association.

The tenant shall keep the premises in a good and clean condition and promptly report any maintenance or safety concerns to the Association’s property manager, which are the responsibility of the Association, as set forth in the governing documents.

Enforcement

It is understood and agreed that the failure of any tenant, occupant, and guest of the Living Unit to abide by the Governing Documents of the Master Association may result in the Association levying monetary fines against the Owner of a Living Unit and/or tenant and possible eviction of the tenant as provided by the Addendum to Lease. In the event that a tenant is evicted for any reason by the Association, the Owner of the Living Unit shall reimburse the Association for any expenses incurred that are associated with the eviction, including court costs, management fees, and any and all of the attorney’s fees, actually incurred.

Rental Living Unit Registration

New Tenants:

An Owner of Living Unit shall register new tenants and occupants by submitting the following documents to the Association’s property manager within ten (10) days of the execution of any lease agreement.

1. A completed and signed Rental Living Unit Registration Form (see Exhibit 1).

2. A signed copy of the Lease.

3. A signed copy of the Association’s Lease Addendum. (see Exhibit 2)

Failure to provide the aforementioned documents shall subject the Owner of Living Unit to monetary fines, and/or suspension of owner and tenant use of common areas and amenities in accordance with the governing documents.

Existing Tenant:

An Owner of Living Unit shall register all tenants and occupants residing in the Living Unit as of the effective date of these rules, by submitting the following documents to the Association’s property manager, within thirty (30) days of the adoption of these Rules and Regulations:

1. A completed and signed Rental Living Unit Registration Form (see Exhibit 1).

2. A signed copy of the Lease.

3. At the expiration of the current Lease, or if the current Lease is extended beyond the current term of the Lease, the Owner of Living Unit shall also submit a signed copy of the Association’s Lease Addendum (see Exhibit 2) which may be obtained at the GlenRiddle
Management Office or on the GlenRiddle website. The Addendum to Lease must be submitted within ten (10) days of the date of the expiration of the current Lease.
