WHEREAS, the Board of Directors is empowered by Article 10 of the Declaration and Section 7.1 (a) of the By-Laws to adopt and publish Community Codes to enhance the quality of life of Owners, protect the aesthetics and environment within the Community and to promote a sense of community among the Owners; and

WHEREAS, Section 10.2 of the Declaration provides that the Community Codes shall have the same force and effect and binding nature as the covenants, conditions, easements and restrictions contained within the Declaration and applicable to all property within the Association; and

WHEREAS, the Board of Directors has determined that the Community would benefit from establishing the rules and regulations set forth below to assure that the rental of Living Units does not adversely impact on the quality of life of the Owners or the community.

NOW, THEREFORE, BE IT RESOLVED, that the Board of Directors of the GlenRiddle Community Association, Inc. hereby rescinds the current Community Code No. 6 and adopts the following as Revised Community Code No. 6:

1. No Living Unit shall be rented to any tenant for less than thirty (30) consecutive days; however, this provision shall apply only to Owners who acquire Living Units after December 31, 2021. An owner of a Living Unit acquired prior to January 1, 2022, shall not rent the unit to any tenant for less than seven (7) consecutive days.

2. All Owners who rent shall register tenants and other occupants with the Association by submitting the documents listed below to the Association’s property manager within ten (10) days after the execution of the lease agreement or before the unit is occupied by the tenant, whichever is earlier:

a. A completed and signed Rental Living Unit Registration Form (see Exhibit 1).

b. A signed copy of the Lease.

c. A signed copy of the Association’s Lease Addendum (see Exhibit 2).

d. Proof of insurance confirming coverage for rental of the Living Unit.

e. A copy of the “Rental License” from Worcester County.

The Registration Form, Exhibit 1, and Addendum, Exhibit 2, can be obtained at the GlenRiddle Management Office or on the GlenRiddle TownSq website.

The failure to provide the aforementioned documents shall subject the Owner to fines, and/or suspension of Owner’s and tenant’s use of common areas and amenities in accordance with the Governing Documents.

3. To defray the costs associated with the rental of Living Units, each Owner who rents a Living Unit shall pay an annual fee of $200 for each access key card (four card limit). In addition, for each rental for a period of 30 consecutive days or less, the Owner shall pay $125.

4. Only three motor vehicles may be parked at one time within 100 yards of the Living Unit that is rented, and a “guest registration” tag provided by the Association shall be attached to the rearview mirror of each such vehicle.

5. The Rules and Regulations of the Association shall be posted conspicuously in each Living Unit that is rented.

6. The failure of a tenant, occupant or guest to abide by the Governing Documents may cause the Owner of the Living Unit to incur fines and could cause the tenant to be evicted as provided in the Addendum to Lease. The Owner of the Living Unit shall reimburse the Association for all expenses incurred in the eviction process, including court costs, management fees, and reasonable attorney’s fees.

The Code shall become effective upon filing in the Homeowners Association Depository for Worcester County, Maryland.
