Neither the Board of Directors, nor the Architectural Control Committee, nor their respective members, successors, agents, representatives, employees, or attorneys shall be liable for damages or otherwise to anyone submitting plans for review and approval, nor to any applicant, by reason of a mistake in judgment, negligence, or non-feasance, arising out of any action of the Architectural Control Committee or Board of Directors with respect to any submission, or for failure to follow these Design Guidelines.
The role of the Architectural Control Committee is directed toward review and approval of use, site planning, appearance, architectural design, and aesthetics.
The Architectural Control Committee assumes no responsibility with regard to design or construction, including, without limitation, the civil, structural, mechanical, plumbing or electrical design, methods of construction, or technical suitability of materials, and no approval issued by the Architectural Control Committee shall be deemed to have approved such design or construction, as stated.
