WHEREAS, the Board of Directors of GlenRiddle Community Association, Inc. has the power and the responsibility to govern and make decisions for the community in accordance with Article 7 (a) of the GlenRiddle By Laws; and
WHEREAS, the Board of Directors is responsible for establishing fines and other penalties for infractions of the Governing Documents, in accordance with Article 7 (b) & (e) of the GlenRiddle By Laws;
NOW, THEREFORE BE IT RESOLVED THAT the Board of Directors of GlenRiddle Community Association, Inc. hereby adopts the following procedures that are applicable regarding curing violations of the community’s Governing Documents:
STANDARD PROCEDURES FOR ADDRESSING COVENANTS VIOLATIONS
TIMELINES FOR ADDRESSING COVENANT VIOLATIONS
Class 1 Violations (identified on attached exhibit)
- Initial sighting by management on property inspection or as reported by the homeowner – homeowner was given informal notice through email or phone call with a 6-day deadline to correct the issue
- 6 days later, Management re-inspects: If the violation is abated, no action taken, if the violation is still present homeowner will be sent written notification of 10 day Community Center privilege suspension and a 10-day deadline to correct
- 10 days later, Management re-inspects; If the violation is abated, no action taken, if the violation is still present homeowner will be sent written notification of a Hearing scheduled for the next Covenants Committee with a 30-day notice.
Class 2 Violations (identified on attached exhibit)
- Initial sighting by management on property inspection or as reported by the homeowner – homeowner was given informal notice through email or phone call with a 30-day deadline to correct the issue.
- 30 days later, Management re-inspects: If the violation is abated, no action taken, if the violation is still present homeowner will be sent written notification of 10 day Community Center privilege suspension and a 10-day deadline to correct.
- 10 days later. Management re-inspects; If the violation is abated, no action is taken, if the violation is still present homeowner will be sent written notification of a Hearing scheduled for the next Covenants Committee with a 30-day notice.
FOR ADDRESSING REOCCURRING COVENANT VIOLATIONS WITH CORRECTION IN BETWEEN
1st Occurrence receives informal contact through email or phone call with 6 days notice to correct
If 2nd Occurrence is repeated the following process will be followed:
- 2nd Occurrence Within One Month of Initial Violation – Written notice of 6 days to correct and 10 day Community Center privilege suspension
- 2nd Occurrence Within 2-6 Months of Initial Violation – Informal contact through email or phone call and warning of a 10-day suspension of Community Center privilege
- 2nd Occurrence After 6 Months of Initial Violation – Informal contact through email or phone with 6 days notice to correct
If 3rd occurrence is repeated the following process will be followed:
- 3rd Occurrence Within One Month of Initial Violation – Written notice of Hearing with Covenants Committee with 30 days notice and a 10-day suspension of Community Center privilege
- 3rd Occurrence Within 2-6 Months of Initial Violation – Written notice of Hearing with Covenants Committee with 30 days notice and a 10-day suspension of Community Center privilege
- 3rd Occurrence After 6 Months of Initial Violation – Written notice of 6 days to correct and 10 day Community Center privilege suspension
If 4th Occurrence Within 1 Year – Written notice of Hearing with Covenants Committee, 30 days notice, and a 10-day suspension of Community Center privilege
The GlenRiddle Board of Directors hereby adopts this Resolution this 8th day of May 2014 at an open Board of Directors meeting where a quorum of the Board was present.
COVENANT VIOLATION CLASSING
Class #1: Violations in which QUICK resolution can be expected (16 days to Hearing)
Class #2: Violations in which more time to resolve should be granted (40 days to Hearing)
Class #1 Violations
- Noxious or offensive trade or activity which may become annoyance/nuisance to other residents (lighting, sound devices)
- Maintenance/keeping of animals, livestock, poultry
- Pets may not be permitted upon Community Property unless carried or leashed
- The person accompanying the pet is responsible for the removal and disposal of solid waste
- No burning of trash
- No accumulation/storage of litter, lumber, scrap
- No junk vehicles/commercial vehicle/trailer/camper/bus/boat shall be kept upon the Property or upon private stets
- No extraordinary maintenance of automobiles
- Trash/garbage/recycling containers shall not be permitted to remain in public view except on collection days
- No tent/trailer/barn, etc. may be erected, used, or maintained without prior written approval
- No decorative lawn ornament which is visible from the street may be erected without prior written approval
- No signs or advertising devices shall be erected or displayed without prior approval
- Only standardized For Sale signs shall be used for the sale or rental of units
- Except for hoses in connection with normal lawn maintenance, no hose/pipes/cables shall be installed above the surface of the ground without approval
- No play equipment (including basketball hoops/backboards) shall be erected or attached without written approval
- Vegetable gardens shall be maintained only in rear yards and screened from public view
- Lawn furniture may be used on front porches or rear yards only unless otherwise approved
- Children’s play equipment may only be erected in rear yards of Living Units with approval
- No Owner shall make any private use of Community Property
- No Owner shall engage or direct any employee nor direct or supervise any employee on private business of the owner during hours in which the employee is employed by the Association
- Bedsheets/Plastic/Towels etc. shall not be hung or placed in any window
- Children’s play equipment shall not remain overnight within Community Property
- Use of clothesline resolution
Class #2 Violations
- No Living Unit shall be divided or subdivided without the approval of BOD
- No tree/hedge/landscape feature shall be planted or maintained which obstructs sight lines for traffic
- No portion of a garage or outbuilding may be used for human habitation
- All sprinkler/irrigation systems shall be subject to approval
- No trees shall be removed from within the Community unless approved
- No window air conditioning units except as permitted by ACC
- Property maintenance including power washing, lattice repair, or lamp post repair
