WHEREAS, the Board of Directors of GlenRiddle Community Association, Inc. has the power and the responsibility to govern and make decisions for the community in accordance with Article 7 (a) of the GlenRiddle By Laws; and
WHEREAS, pursuant to Article 10, Section 10.2 (a.) of the Declaration, the Board of Directors may establish, modify, cancel, limit, create exceptions to, or expand Community Codes; and
WHEREAS, Article 10 of the Declaration provides that Community Codes shall have the same force and effect and binding nature as the covenants, conditions, easements, and restrictions contained within the Declaration and applicable to all property within the Community;
WHEREAS, the Board of Directors desires to establish a Landscaping Reimbursement Request Policy for the benefit of the Community and its residents;
NOW, THEREFORE BE IT RESOLVED THAT the Board of Directors of GlenRiddle Community Association, Inc. hereby adopts the following which, as may be modified or amended from time to time, shall be binding on all parties having any right, title, or interest in all or any portion of the Community, their respective heirs, personal representatives, successors, transferees and assigns, as well as occupants, guests, and invitees, and shall inure to the benefit of each Owner thereof.
Unless otherwise defined herein, capitalized terms used herein shall have the same meanings as set forth for them in the Declaration.
The Board of Directors agrees that homeowners may opt-out of the full-service landscaping provided by the association’s landscaper and then request a refund at the end of the year providing management and the Board feels they have maintained their yard to the standards and aesthesis of the community.
No reimbursements will be provided for homeowners opting out of selective services, i.e. mulching, pruning, and/or a weekly lawn cut, or for notifications that are received after the deadline specified below.
Any resident who wishes to opt-out of the full-service landscaping must submit their request by December 1st of the current year for the following years’ services.
Any resident who opted out of full-service landscaping per the deadline above, and met the requirement of maintaining their yard to the Board’s standards, must submit their request for landscaping reimbursement after December 1st of the opted-out year but no later than January 31st of the year following the opt-out.
IN WITNESS WHEREOF, the undersigned, GlenRiddle Board of Directors hereby executes this Resolution this 21st day of March 2013 at an open Board of Directors meeting where a quorum of the Board was present.
