An important part of meeting this obligation is for your charity to check, before appointing a Responsible Person, that the person is not disqualified.
A charity can do this by:
- searching the ASIC Disqualified Persons Register
- searching the ACNC Register of Disqualified Persons, and
- asking their Responsible People to sign a declaration confirming that they are not disqualified and agree to notify the charity if the person becomes disqualified in the future

Club Tip When you are calling for nominations, include the declaration below to ensure the persons applying for the positions are aware they must not be a disqualified person. |
Nominees Declaration
- I am the holder of a positive notice Blue Card
- I have completed required child safety inductions
- I am not disqualified from managing a corporation within the meaning of the Corporations Act 2001
- I have not been disqualified by the Australian Charities and Not for Profits Commission at any time during the previous year from being a responsible person (as per the ACNC Act)
- I agree to this nomination
