EQ-001 Restricted Access

In certain circumstances, access to a project or to a waterway, may be restricted to protect the building occupants or the public, such as:

  • Daycares, preschools, K-12 schools, and similar facilities may restrict public access to ensure the safety of students.
  • Commercial projects do not need to allow access to all portions of the project, but must allow the public some access to experience and learn about the project.
  • Working docks, marinas, or other commercial facilities on waterfront land may restrict public access to that waterway to ensure public safety and protect the function of the businesses.

In all cases, project teams are encouraged to provide as much access to the project and to natural resources as possible.

Project teams must provide a narrative detailing the safety concerns, the manner in which these concerns were mitigated, and the publicly accessible features provided to meet the intent of this Imperative without compromising the safety of the building’s occupants.

EQ-002 ADA and ABA Exceptions 

ADA and ABA compliance is not required for private residences, historic structures, or other building types that are exempt from ADA and ABA guidelines. Project teams using this Exception must provide documentation that they meet an ADA and ABA exemption, and must apply relevant aspects of Universal Design to the project.

EQ-003 ADA and ABA International Equivalency 

There are countries and circumstances in which the ADA or ABA may not be suitable and/or local regulations are equivalent or even more stringent. In such situations, a project team may defer to local regulations. Project teams that use this Exception must provide a thorough analysis of the relevant ADA and ABA requirements and the equivalent local standards, demonstrating that their local code meets the intent of ADA and ABA requirements through different means.

EQ-004 Mitigation of Shading Impacts 

If negative shading impacts are not able to be managed through the design, the project team must demonstrate that the neighboring property was given fair and just compensation.
