Surf Life Saving powercrafts are recognised by Queensland Transport as a marine vessel. Therefore, Queensland Transport regulations must be adhered to in the cases. It is the skippers/masters responsibility to report the incident.
Under the Transport Operations (Marine Safety) Act 1994 (TOMSA), a marine incident is classified as an event causing or involving:
- The loss of a person from a ship; or
- The death of, or grievous bodily harm to, a person caused by a ship’s operations; or
- The loss or presumed loss or abandonment of a ship; or
- A collision with a ship; or
- The stranding of a ship; or
- Significant damage, or danger of significant damage, to a ship; or
- Significant damage caused by a ship’s operations; or
- Danger to significant damage to a structure cause by a ship’s operations; or
- Danger to a person caused by a ship’s operations.
If a Queensland regulated ship is involved in a marine incident listed above, the master of the ship must report the marine incident to a shipping inspector within 48 hours after the incident happens, unless the master has a reasonable excuse for not complying with this subsection. A F3071 Marine Incident Report Form must be completed; failure to do so within 48 hours is a breach of the law and penalty will apply to the owners and master of the ship.

All powercraft injuries (major/minor) must have a LIMSOC IRL completed. This form will be required to be submitted if making a WorkCover QLD claims.
Members have the responsibility to operate within the Queensland Transport guidelines and regulations. Not to do so, can jeopardise marine safety causing injury or death and render the operator and club liable to criminal prosecution and civil litigation.
As part of the organisations operating procedures and exemptions any breach to Surf Life Saving Queensland Powercraft Safety Management System (includes but not limited to SLSA Powercraft training manual, Patrol Operations Manual, Powercraft Code of Conduct, training resources, SLSQ policies and Procedures and Powercraft risk register) will result in an internal investigation.
SLSQ will not be held responsible for any breaches/fines that the club or member are given.
