This privacy policy (the “Privacy Policy”) describes how the Trust collects, uses and discloses information and data relating to your access and use of the Trust’s Websites and what rights you have with respect to such information and data. The Privacy Policy forms part of the Trust’s Terms of Use accessible at https://www.manula.com/manuals/skeena-knowledge-trust/skeena-knowledge-trust/1/en/topic/website-terms-of-use. Any capitalized terms used but not defined in the Privacy Policy have the meaning ascribed in the Terms of Use.

By using the Websites, you indicate your acceptance of the Terms of Use and Privacy Policy. If you do not accept the Terms of Use and Privacy Policy, then do not use the Websites.

The Trust reserves the right to update and change the Privacy Policy from time to time by posting updates and changes to the Websites. By continuing to use the Websites after such changes are posted, you agree to such changes.

1. Information Collected & Generated

If you use the Websites, you will end up submitting information to the Trust. Like most internet-based programs, we might receive other information that relates to you automatically or through third parties.

In the course of your accessing and using the Websites, the Trust may collect and/or generate the following types of information (collectively “User Information”):

a) “Personal Information”, which means information that could be used by itself to identify you, such as your name, email address and any other information you include on your user profile;

b) “Educational Information”, which means any Content or other information and data posted by users to the Websites which assists public education;

c) “Service Information”, which means information generated by your use of the Websites, including the following:

i) Website Metadata. When you interact with the Websites, metadata may be generated that provides additional context about the way you engage the Websites. For example, the Trust logs the type of activity engaged to better understand which features and tools are most used or in need of improvement;

(ii) Log Data. As with most websites and technology services delivered over the internet, the Trust servers may automatically collect and record information when the Websites are accessed. This log data may include the Internet Protocol (IP) address, the address of the web page visited before using the Websites, browser type and settings, the date and time the Websites were used, information about browser configuration and plugins, language preferences and cookie data. This information is used to optimize the delivery of the Websites;

(iii) Device Information. The Trust may collect information about devices used to access the Websites, including the type of device, what operating system is used, device settings, application IDs, unique device identifiers and crash data. Whether the Trust collects some or all of this information often depends on the type of device used and its settings. This information is used to optimize the delivery of the Websites;

(iv) Location Information. The Trust may collect information to determine your approximate location, such as IP address or any other location information from devices in accordance with the consent process provided by the device;

(v) Cookie Information. The Trust may use cookies and similar technologies through the Websites that help collect information about your engagement with the Websites. The Websites may also include cookies and similar tracking technologies of third parties. If you do not wish to accept cookies, you have the option of blocking or disabling cookies. Your computer provides you with the ability to clear all cookies that have been stored onto your hard drive, should you wish to do so. However, please be aware that you may be unable to access certain parts of the Websites if you block or disable cookies;

(vi) Third Party Website. The Trust may receive data about organizations, industries, website visitors, marketing campaigns and other matters related to the Websites from parent corporation(s), affiliates and subsidiaries, Trust partners or others that the Trust uses to make the Service Information more useful. This data may be combined with other Service Information and might include aggregate level data, such as which IP addresses correspond to zip codes or countries; and

(vii) Additional Information Provided to Trust. The Trust may receive other information from you through User Content or if you participate in posting Content, request support, interact with any Trust social media accounts or otherwise communicate with or through the Trust.

Generally, you are not under a statutory or contractual obligation to provide any information or data to the Trust. However, certain information and data is collected automatically when accessing and using the Websites, and blocking such collections may result in the Trust’s inability to provide you with access and use to any part or whole of the Websites.

2. Information Use

User Information will be used by the Trust to provide the Websites to you in accordance with the Terms of Use and as required by applicable law, legal process or regulation. Without limiting the foregoing, User Information may be used by the Trust for the following purposes:

a) to provide, update, maintain and protect the Websites;

b) to communicate with you by responding to your requests, comments and questions;

c) to develop and provide additional features;

d) to send you communications which may relate to changes in the Websites, changes to the Content, and important notices, such as security notices. These communications are considered part of the Websites and you may not opt out of them;

e) for account management and other administrative matters; and

f) to investigate and help prevent security issues and abuse.

3. Information Retention

The Trust will generally continue to store archived copies of your User Information for legitimate administrative and educational purposes and to comply with applicable law, except when the Trust receives a valid erasure request, or, if your User Information is purged pursuant to the Trust’s standard purge process.

4. Information Sharing

This section describes how the Trust may share and disclose User Information:

a) Customer’s Instructions. The Trust will only share and disclose User Information in accordance with the Terms of Use, your instructions from time to time, and as required by applicable law. Your consent to the Trust’s sharing and disclosing of certain User Information may be reasonably determined by your action through the Websites.

b) Third Party Service Providers and Partners. The Trust may engage third party companies or individuals as service providers or business partners to process User Information and support the Trust business. These third parties may, for example, provide virtual computing and storage for the Websites.

c) Corporate Affiliates. The Trust may share User Information with its corporate affiliates, parents and/or subsidiaries.

d) Aggregated or De-identified Data. The Trust may disclose or use aggregated or de-identified User Information for any purpose. For example, the Trust may share aggregated or de-identified User Information with prospects or partners for business or research purposes.

e) To Comply with Laws. If the Trust receives a request for information, the Trust may disclose User Information if the Trust reasonably believes disclosure is in accordance with or required by any applicable law, regulation or legal process. The Trust is released of any liability associated with any such disclosures made in good faith.

f) To Enforce Rights, Prevent Fraud, and for Safety. The Trust may disclose or use User Information to protect and defend the rights, property or safety of the Trust or third parties, including enforcing policies, or in connection with investigating and preventing fraud or security issues.

g) With Consent. The Trust may otherwise share User Information with third parties when the Trust has your consent to do so.

5. Security

The Trust takes commercially reasonable steps to protect the User Information from loss, misuse, and unauthorized access or disclosure. These steps take into account the sensitivity of the User Information and the current state of technology. For certain instances when your User Information is shared with third parties, the Trust may be unable to access, correct, amend, delete, or limit such User Information. User Information may be processed on servers located outside of the country where you live. No method of transmission over the Internet or method of electronic storage is 100% secure. While we strive to protect your User Information, the Trust cannot guarantee the security of any information you transmit to us.
