The Central Bank of Ireland defines an advertisement in the Consumer Protection Code as:
“Any commercial communication in respect of a regulated entity, which is addressed to the consumer public or a section of it, the purpose being to advertise a regulated activity or a regulated entity, excluding name plaques, sponsorship material and a prospectus drawn up in accordance with the prospectus Directive (2003/71/EC)”
If conducting advertising, you should be aware of some of the specific requirements which apply.
These include:
▪ Consumer Protection Code – Chapter 3, Section 3.9 which states that warning statements must
be in a box, in bold type, and of a font size that is at least equal to the predominant font used
throughout the document or advertisement. (Appendix 5),
▪ Consumer Protection Code – Chapter 9 – covers the specific issues in relation to advertising
requirements (Appendix 5),
▪ Guidance on the Advertising Requirements of the CPC, October 2013 (Appendix 6),
▪ Consumer Mortgage Credit Agreements) Regulations 2016 (CMCAR) – Advertising
Requirements
▪ Consumer Credit Act, 1995 – certain requirements and warnings which must be included.
