At XSTRA, we are often asked:

“is my data safe in the cloud?”

.
We feel we would not be doing our job as advocates for our Clients if we didn’t bring the information below to your attention.

Here are some of the terms and conditions from 2 of the biggest names in the Cloud space.

Is your data safe? – We will let you decide………………….

Section 2
“When you upload, submit, store, send or receive content to or through Google Drive, you give Google a worldwide license to use, host, store, reproduce, modify, create derivative works (such as those resulting from translations, adaptations or other changes we make so that your content works better with our services), communicate, publish, publicly perform, publicly display and distribute such content. The rights you grant in this license are for the limited purpose of operating, promoting, and improving our services, and to develop new ones. This license continues even if you stop using our services unless you delete your content. Make sure you have the necessary rights to grant us this license for any content that you submit to Google Drive.”

5. Program Policies
We may review content to determine whether it is illegal or violates our Program Policies, and we may remove or refuse to display content that we reasonably believe violates our policies or the law. But that does not necessarily mean that we review content, so please don’t assume that we do.

And now for OneDrive – Section 2B and 6 – https://www.microsoft.com/en-au/servicesagreement/

“2b. To the extent necessary to provide the Services to you and others, to protect you and the Services, and to improve Microsoft products and services, you grant to Microsoft a worldwide and royalty-free intellectual property license to use Your Content, for example, to make copies of, retain, transmit, reformat, display and distribute via communication tools Your Content on the Services. If you publish Your Content in areas of the Service where it is available broadly online without restrictions, Your Content may appear in demonstrations or materials that promote the Service. Some of the Services are supported by advertising. Controls for how Microsoft personalizes advertising are available on the Security & privacy page of the Microsoft account management website. We do not use what you say in email, chat, video calls or voice mail, or your documents, photos, or other personal files to target advertising to you. Our advertising policies are covered in detail in the Privacy Statement.”

“6. Service Availability.

a. The Services, Third-Party Apps and Services, or material or products offered through the Services may be unavailable from time to time, maybe offered on a limited basis or may vary depending on your region or device. If you change the location associated with your Microsoft account, you may need to re-acquire material or applications that were available to you and paid for in your previous region. You agree not to access or use material or Services which are illegal or not licensed for use in the country from which you access or use such material or Services, or to conceal or misrepresent your location or identity in order to access or use such material or Services.
b. We strive to keep the Services up and running; however, all online services suffer occasional disruptions and outages and Microsoft is not liable for any disruption or loss you may suffer as a result. In the event of an outage, you may not be able to retrieve Your Content or Data that you’ve stored. We recommend that you regularly backup Your Content and Data that you store on the Services or store using Third-Party Apps and Services .”
