TICE is committed to maintaining safe, healthful and efficient working conditions for our employees. For these reasons, TICE requires its employees to present themselves for service free from the influence of any substance, including legal drugs, illegal drugs, or alcohol. This policy is designed to assist TICE and its employees in maintaining an alcohol and drug free workplace environment. TICE reserves the right to drug test any employee at any time and TICE does randomly drug test employees. TICE has a ZERO tolerance for the use of illegal substance or misuse of any legal substance and you will be terminated immediately if at any time you have a drug test result that is not acceptable to company standards.
TICE prohibits an employee’s use, possession, manufacture, distribution, sale, or attempted similar conduct, of illegal drugs or drug paraphernalia on TICE’s premises as well as employees reporting to work or working with illegal drugs and/or alcohol in their system. If you suspect a guest of possessing illegal drugs on our property, notify a manager immediately. Additionally, each employee should discourage and report all individuals violating this policy. Pursuing the measures set forth below will assist TICE in effectively carrying out this policy.
Definitions:
A. Drug – Any substance (other than alcohol) which may, can, or does alter the mood, perception, conduct, or judgment of the individual consuming it — including the following:
- “Legal Drug” includes prescribed drugs and over-the-counter drugs which have been legally obtained and are being used only in the amounts prescribed and for the purpose for which they were prescribed or manufactured.
- “Illegal Drug” means any drug which (a) is not legally obtainable, (b) is legally obtainable but has not been legally obtained, or © is obtained legally but abused. The term includes prescribed drugs not being used for prescribed purposes. It also includes, without limitation, those drugs classified as narcotics, stimulants, depressants, hallucinogens, and cannabis.
B. “Under the influence” means that in the opinion of TICE, the employee has illegal drugs and/or alcohol in his/her system and the use is detectable in any manner. The symptoms of influence are neither confined to those consistent with misbehavior, nor confined to obvious impairment of physical or mental ability such as slurred speech, smell of alcohol or marijuana on the breath, or difficulty in maintaining balance.
C. “TICE premises” is used in its broadest sense and includes all land, property, buildings, structures, installations, parking lots and means of transportation being utilized for TICE business, and all other locations where TICE employees may perform work. Private vehicles on TICE’s premises are included within this definition.
Drug and/or Alcohol Prohibitions and Requirements
A. Legal Drugs: Employees whose use of a legal drug directly and significantly threatens the health or safety of themselves or others or impairs the employee’s job performance shall report such drug use to their immediate supervisor.
B. Illegal Drugs & Alcohol: The use, possession, manufacture, distribution, sale, or attempted similar conduct, or being under the influence of an illegal drug by an employee during working time or during non-working time while on TICE premises is prohibited. The use or being under the influence of alcohol by an employee during working time is prohibited.
C. Drug Offenses: Any employee who is convicted or pleads guilty to an unlawful drug offense occurring on non-working time may be subject to disciplinary action up to and including termination of employment.
Compliance with TICE’s Drug and Alcohol Policy is a condition of employment. Any employee, who in TICE’s sole discretion, is determined to be in violation of this Policy immediately will be relieved of his/her duties. Additionally, failure or refusal of an employee to cooperate fully, or meet any or all of the requirements set forth in this policy, will result in disciplinary action, up to and including termination. The nature and severity of discipline for violating this policy will be determined in TICE’s sole discretion.
This Drug and Alcohol Policy is not intended to create, and does not create, a contract of employment, either express or implied, between TICE and any of its employees for employment, hours of work, or the providing of benefits. TICE may implement a new and different policy should it choose to do so at any time. Additionally, TICE may modify, revoke, suspend, terminate, or change this policy, in whole or in part, at any time, retroactively or prospectively, with or without notice. TICE’s interpretation of this policy is final and binding.
