Certain situations and events occurring in the employment relationship require the administration of discipline. The following forms of discipline are used when appropriate: verbal warning, written warning, suspension without pay and discharge from employment.

The above-listed disciplinary measures are set forth as illustrations of the measures most often used. The listing, however, is not exhaustive and does not obligate us to administer discipline on a progressive basis. We reserve the right to use any disciplinary measure that, in our view, is appropriate in light of the conduct involved. Thus, we have the exclusive right and sole discretion to determine in what instances to impose discipline and to determine what level of discipline to impose.

Violation of any of the following rules may result in discipline, up to and including termination. This listing is merely illustrative and is by no means an exhaustive list of the acts for which discipline may be imposed. Other inappropriate actions may result in disciplinary action:

  1. Dishonesty;
  2. Threatening, intimidating, coercing or being abusive to co-workers, customers or others;
  3. Unauthorized possession of weapons, firearms or explosives;
  4. Willful damage of equipment or property;
  5. Conviction of a felony while employed;
  6. Immoral or indecent conduct;
  7. Physical assault/battery of fellow employees;
  8. Deliberate omission or falsification of significant information (applications, etc.);
  9. Alcohol or drug-related offenses;
  10. Willful violation of security or safety rules or failure to observe safety rules;
  11. Theft of Company property or the property of fellow employees;
  12. Insubordinate acts or statements or failure to carry out orders;
  13. Sleeping on the job;
  14. Gambling on the premises;
  15. Refusing to work and/or refusing to clock out when told to do so by a manager;
  16. Willful negligence, including leaving facility without approval;
  17. Failure to report to work for three consecutive days without notifying his/her supervisor;
  18. Repeated or continued minor infractions;
  19. Work performance not up to established standards;
  20. Performing work other than company assignments while at work;
  21. Distributing literature and soliciting on company premises during working hours;
  22. Failure to notify supervisor of absence at least four (4) hours prior to absence;
  23. Poor attitude, including but not limited to, an attitude that creates an atmosphere of negativity that impedes the work of your fellow employees;
  24. Inability to support our goals/programs;
  25. Habitual tardiness or absenteeism;
  26. Attending to personal affairs on company time;
  27. Consumption or use of alcoholic beverages, illegal drugs or controlled substances or other unprescribed controlled substances on company premises or while performing services for company;
  28. Working or being at work while under the influence of alcoholic beverages, illegal drugs or controlled substances or other unprescribed controlled substances;
  29. Violation of our confidentiality policy;
  30. Violation of other company policies and procedures.
  31. Leaving a work area or workstation without permission or approval from Shift Manager.
  32. Using Cell Phone while on Duty (using cell phone without changing gloves is a food safety violation and will lead to immediate termination)
