A. The PEC is composed of ten members, one representative from each region and a Chair. Members are elected for three-year term (renewable for another term) by the Board of Representatives upon nomination by the Representation and Nomination Committee from the candidate(s) suggested by each region. Preference will be given to people with training in the ACPE, APC or NAJC Ethics Codes and Procedures

Members are eligible to succeed themselves one time after completing a full three-year term. Persons completing a partial term of office for another member are still eligible to complete two full terms on the Commission. Commission members must rotate off the Commission for one year prior to becoming eligible to return as a member.

B. The Chair serves a single term of three years and must rotate off the Commission for one year prior to becoming eligible for re-election as a PEC member.

C. The Chair-elect, nominated by the Representation and Nomination Committee on recommendation of the Professional Ethics Commission and elected by the Board of Representatives, serves during the final year of the Chair’s term and then automatically becomes Chair. If not already a member of the Commission, the Chair-elect serves in addition to members serving their terms. When the Chair-elect becomes the Chair and has an unexpired term on the Commission, the Board of Representatives appoints a person from that region to complete the unexpired term. The Chair-elect will be a current or recent past member of the Commission.

During the last year in office, the Chair will consult with the Chair-elect on outstanding cases to provide for an orderly transition. When it appears those cases will not be disposed of before the current Chair’s term of office expires, the Chair-elect will assume the role of Chair for all pending and new cases that come before the Commission.

Nominees for the Commission and Chair-elect must have a current Accountability for Ethical Conduct Form on file in the ACPE office. A person is ineligible for nomination without the form and/or if they are party to an Ethics case pending or in process within ACPE or APC.
